1. OVERVIEW AND SCOPE
This Ticket Buyer Policy outlines the terms and conditions that apply when any individual (“Consumer” or “Attendee”) purchases tickets to events listed on the Eventably platform, website, mobile applications, or related services (collectively, the “Platform”). Eventably, LLC (“Eventably,” “we,” “us,” or “our”) provides the technology platform that enables event organizers (“Organizers,” “Customers”) to create, manage, and promote events, and facilitate ticket sales to those events.
This Policy supplements our Terms of Use and should be read in conjunction with our Privacy & Data Protection Policy and other applicable policies. By purchasing tickets through the Platform, each Consumer acknowledges that such Consumer has read, understood, and agrees to be bound by this Policy and all referenced documents.
2. EVENTABLY’S ROLE AS TECHNOLOGY PLATFORM
Eventably operates solely as a technology platform that connects event organizers with individuals seeking to attend events. We provide the technological infrastructure that enables Organizers to list their events and process ticket sales, but we are not a party to the transaction between Consumers and Organizers.
Direct Relationship with Organizers.
By purchasing a ticket through Eventably, each Consumer is entering into a direct contractual relationship with the Organizer of the event. Eventably serves only as the platform facilitating this transaction and providing payment processing services. We do not organize, host, promote, sponsor, or endorse any events listed on the Platform.
No Event Responsibility.
Eventably is not responsible for any aspect of the events themselves, including their quality, content, safety, legality, delivery, or compliance with applicable laws. All such responsibilities rest solely with the Organizer. We make no representations or warranties regarding any event listed on the Platform.
Limited Platform Role.
Our role is strictly limited to providing the technology infrastructure that enables event discovery, ticket purchasing, and payment processing. We do not guarantee that any event will occur as scheduled, meet any particular standards, or provide any specific experience.
3. TICKET PURCHASING AND PAYMENT
Payment Processing.
All ticket purchases are processed through our integrated payment processing system using Stripe and other approved payment providers. By making a purchase, each Consumer agrees to be bound by the applicable payment processor’s terms of service in addition to this Policy.
Pricing and Fees.
Ticket prices are set by Organizers and displayed during the purchase process. The total cost of any purchase includes the ticket price set by the Organizer plus any applicable taxes, processing fees, or additional charges. All fees are clearly disclosed before Consumers complete their purchases.
Purchase Confirmation.
Upon successful completion of a purchase, the applicable Consumer will receive a confirmation email containing ticket information and relevant event details. This confirmation serves as the Consumer’s proof of purchase and may be required for event entry.
Payment Security.
We employ industry-standard security measures to protect Consumer payment information during the transaction process. We encourage all Consumers to review their payment statements regularly and report any unauthorized charges to their payment providers immediately.
4. TICKET DELIVERY AND ACCESS
Electronic Delivery.
Tickets are delivered electronically via email to the address provided during purchase. Tickets may also be available for download through Consumer Eventably accounts or accessible via mobile device, depending on the Organizer’s preferred delivery method.
Delivery Method Responsibility.
The specific ticket delivery method (email, account download, mobile access, QR codes, etc.) is determined by the Organizer. Eventably is not liable for delivery failures caused by incorrect email addresses, spam filtering, technical issues with the Organizer’s systems, or other factors beyond our reasonable control.
Account Access.
If any Consumer creates an account on the Platform, such Consumer’s purchased tickets will be accessible through the account dashboard. Each Consumer is responsible for maintaining the security of such Consumer’s account credentials and ensuring such Consumer can access tickets when needed.
Technical Requirements.
Some ticket delivery methods may require specific technical capabilities (smartphone access, internet connectivity, PDF viewing, etc.). Each Consumer is responsible for ensuring such Consumer has the necessary technology to access and display tickets as required by the Organizer.
5. EVENT ENTRY AND ATTENDANCE
Entry Requirements.
Organizers may impose various requirements for event entry, including but not limited to presentation of QR codes, printed tickets, government-issued identification, proof of vaccination, age verification, or compliance with dress codes or security policies. These entry requirements are established by the Organizer. Consumers should contact Organizers directly for specific details regarding entry requirements and event policies.
Organizer Authority.
The Organizer has sole authority over admission policies, entry procedures, and event attendance rules. It is each Consumer’s responsibility to review and comply with all entry requirements specified by the Organizer. Consumers should communicate directly with Organizers to clarify any questions regarding entry requirements. Failure to meet these requirements may result in denial of entry without refund.
No Entry Guarantee.
Eventably makes no guarantees regarding any Consumer’s admission to any event. Entry is subject to the Organizer’s policies, venue capacity, security requirements, and other factors determined by the Organizer. Purchase of a ticket does not guarantee entry if the Consumer fails to meet the Organizer’s requirements or if the event is cancelled, postponed, or modified.
Security and Conduct.
Each Consumer agrees to comply with all venue rules, security procedures, and conduct requirements established by the Organizer and venue operators. Disruptive behavior, violation of venue policies, or failure to comply with security requirements may result in removal from the event without refund.
6. TICKET TRANSFER AND RESALE
Transfer Restrictions.
Ticket transfer, resale, or duplication policies are established by the individual Organizer and may vary by event. Some events may prohibit any transfer or resale, while others may allow transfers under specific conditions or through designated platforms. Consumers should contact Organizers directly for information regarding transfer and resale policies.
Organizer Authorization.
Any permitted ticket transfer or resale must comply with the Organizer’s stated policies. Unauthorized resale, duplication, or transfer may result in ticket cancellation, denial of entry, or legal action by the Organizer.
Platform Limitations.
Eventably does not provide ticket transfer or resale services unless specifically offered by the Organizer through the Platform. We are not responsible for facilitating transfers between Consumers or resolving disputes related to unauthorized resales.
Fraud Prevention.
To prevent fraud and protect all parties, tickets may include security features, unique identifiers, or other anti-counterfeiting measures. Attempting to duplicate, modify, or fraudulently transfer tickets may result in cancellation and potential legal consequences.
7. CANCELLATIONS AND REFUND POLICIES
Organizer Refund Responsibility.
Eventably does not issue refunds for ticket purchases. The Organizer is solely responsible for establishing, publishing, communicating, and enforcing refund and cancellation policies for their events. Each Organizer may have different refund policies, ranging from full refund availability to no refunds under any circumstances.
Policy Disclosure.
Organizers are required to clearly display their refund and cancellation policies during the ticket purchase process. All Consumers are strongly advised to review these policies carefully before completing their purchases, as they will govern any refund requests.
Default No-Refund Policy.
If an Organizer has not established a specific refund policy, ticket purchases are considered non-refundable by default, subject to applicable consumer protection laws and mandatory refund requirements in the Consumer’s jurisdiction.
Direct Communication Required.
All refund requests must be directed to the Organizer, not to Eventably. Each Consumer must contact the Organizer directly using the contact information provided in the Consumer’s purchase confirmation or event listing. Consumers should communicate directly with Organizers regarding all refund-related inquiries. Eventably does not process refunds on behalf of Organizers and cannot override an Organizer’s refund policy.
Event Changes and Cancellations.
If an event is cancelled, postponed, relocated, or significantly modified, the Organizer is responsible for notifying attendees and implementing their stated policies regarding refunds or alternative arrangements. Consumers should contact Organizers directly for information regarding event changes and applicable policies. Eventably is not responsible for providing refunds or compensation in such situations.
Consumer Protection Laws.
While Eventably does not provide refunds, Consumers may have rights under applicable consumer protection laws in their jurisdictions. These rights are separate from and in addition to any refund policies established by Organizers. Consumers should consult local consumer protection agencies if they believe their rights have been violated.
Chargeback Limitations.
Initiating chargebacks or payment disputes should be a last resort and may result in account suspension or termination. Before pursuing chargebacks, Consumers should attempt to resolve refund issues directly with the Organizer in accordance with the Organizer’s stated policies.
8. EVENT QUALITY AND LIABILITY DISCLAIMERS
No Event Warranties.
Eventably makes no representations or warranties regarding the quality, content, safety, legality, or delivery of any events listed on the Platform. We do not guarantee that events will occur as scheduled, meet any particular standards, or provide any specific experience or value.
Organizer Responsibility.
Event Organizers are solely responsible for all aspects of their events, including planning, promotion, delivery, safety, compliance with applicable laws, and attendee satisfaction. Any issues, complaints, or concerns regarding an event must be directed to the Organizer, not to Eventably. Consumers should communicate directly with Organizers regarding all event-related matters.
Limitation of Liability.
Eventably is not liable for any personal injury, property damage, financial loss, disappointment, or other damages arising from any Consumer’s attendance at or participation in any event. Consumers attend events at their own risk and assume all responsibility for their safety and well-being.
Third-Party Venues and Services.
Many events take place at third-party venues or involve third-party service providers. Eventably is not responsible for the actions, policies, safety measures, or service quality of these third parties. Consumer interactions with venues and service providers are governed by their respective terms and policies.
Force Majeure Events.
Eventably is not liable for event cancellations, postponements, or modifications due to circumstances beyond the Organizer’s reasonable control, including natural disasters, pandemics, government actions, venue unavailability, or other force majeure events.
9. DISPUTE RESOLUTION AND COMPLAINTS
Direct Resolution with Organizers.
All disputes, complaints, or issues related to ticket purchases, event experiences, refunds, or attendee treatment must be resolved directly with the Organizer. Consumers should communicate directly with Organizers to resolve any disputes or concerns. Eventably does not mediate, arbitrate, or resolve disputes between Consumers and Organizers.
Platform-Related Issues.
If any Consumer experiences technical issues with the Platform itself (payment processing errors, account access problems, ticket delivery failures), such Consumer may contact Eventably’s customer support. However, Issues related to event content, quality, or delivery remain the Organizer’s responsibility.
Documentation and Records.
We recommend that Consumers maintain copies of all purchase confirmations, communications with Organizers, and documentation related to their ticket purchases and event attendance. This information may be helpful in resolving any disputes that arise.
Legal Remedies.
Consumer legal remedies for event-related disputes are against the Organizer, not Eventably. Consumers may pursue available legal remedies under applicable consumer protection laws, contract law, or other relevant legal theories directly against the Organizer.
10. ACCOUNT MANAGEMENT AND COMMUNICATION
Account Information.
If any Consumer creates an account on the Platform, such Consumer is responsible for maintaining accurate and current contact information. This ensures the Consumer receives important communications about purchases and any event updates from Organizers.
Communication Preferences.
By purchasing tickets, each Consumer consents to receive transactional communications related to such Consumer’s purchases, including purchase confirmations, event updates, and important notices from both Eventably and Organizers. Consumers may also opt in to receive marketing communications, which can be managed through their account settings.
Organizer Contact Information.
Organizers are required to provide accurate contact information for Consumer inquiries. If any Consumer cannot reach an Organizer through the provided contact methods, such Consumer may report this issue to Eventably, though we cannot guarantee resolution of the underlying dispute.
Account Suspension.
Eventably reserves the right to suspend or terminate accounts for violations of our Terms of Use, fraudulent activity, or abuse of the Platform. Account suspension does not affect the validity of previously purchased tickets or Consumer obligations to Organizers.
11. PRIVACY AND DATA PROTECTION
Data Collection and Use.
Consumer personal information is collected and used in accordance with our Privacy & Data Protection Policy. By purchasing tickets, each Consumer consents to the collection, processing, and sharing of such Consumer’s information as described in that policy.
Organizer Data Sharing.
When any Consumer purchases tickets to an event, such Consumer’s relevant contact and purchase information is shared with the Organizer to facilitate event communication and management. Organizers are responsible for their own data protection practices and compliance with applicable privacy laws.
International Data Transfers.
If any Consumer purchases tickets for events outside such Consumer’s country of residence, such Consumer’s personal information may be transferred internationally in connection with the transaction and event management. Each Consumer consents to such transfers as necessary to complete purchases and participate in events.
Marketing Communications.
Organizers may use Consumer contact information to send event-related updates and marketing communications in accordance with their own privacy policies and applicable laws. Consumers should review each Organizer’s privacy practices and communication preferences separately.
12. ACCESSIBILITY AND ACCOMMODATIONS
Accessibility Information.
Eventably is committed to accessibility and encourages Organizers to provide comprehensive accessibility information for their events. Specific accessibility accommodations and venue accessibility are the responsibility of the Organizer and venue operator.
Accommodation Requests.
Requests for disability accommodations, accessibility assistance, or special needs services should be directed to the Organizer, as they are responsible for ensuring their events comply with applicable accessibility laws and providing reasonable accommodations. Consumers should communicate directly with Organizers regarding accessibility needs and accommodation requests.
Platform Accessibility.
We strive to maintain an accessible Platform that complies with applicable accessibility standards. If any Consumer encounters accessibility barriers while using the Platform, such Consumer should contact our support team for assistance.
13. GOVERNING LAW AND JURISDICTION
This Policy is governed by the laws of the State of Maryland, United States, without regard to conflict of laws principles. Any disputes arising under this Policy shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, conducted by a single arbitrator in Anne Arundel County, Maryland.
Each Consumer waives any right to participate in class action lawsuits or class-wide arbitration proceedings. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
14. POLICY MODIFICATIONS
Eventably may modify this Policy at any time by posting updated terms on the Platform and updating the “Effective Date” at the top of this document. Material changes will be communicated through email notification or prominent notice on the Platform.
Any Consumer’s continued use of the Platform after any modifications constitutes acceptance of the updated Policy. If any Consumer does not agree to any changes, such Consumer must stop using the Platform, though previously purchased tickets remain subject to the terms in effect at the time of purchase.
